Elon Musk and Twitter are not even in the courtroom yet, and the two sides are already battling for position. Twitter is looking to move quickly to get a court date and move forward with the trial to force Musk to buy the social media platform.
However, Elon Musk’s lawyer noted that Twitter’s request for a trial starting in September is:
an extremely rapid schedule for a case of this enormous magnitude.
Twitter is looking to secure a four-day trial in September. In contrast, Musk’s legal team is requesting a February 2023 court day at the earliest.
As per Musk’s legal team, they require time to complete a “forensic review and analysis of large swaths of data” before moving forward.
In addition, Musk’s lawyers argued in the filing that:
Twitter’s sudden request for warp speed after two months of foot-dragging and obfuscation is its latest tactic to shroud the truth about spam accounts long enough to railroad defendants into closing. (via Bloomberg)
The case is being heard in Delaware Chancery Court, which moves quicker than most jurisdictions.
The vast majority of cases are heard within six to seven months when the lawsuit is filed, when not determined to be a fast track case.
A judge will hold a hearing on July 19 on whether to put the case on a fast track or not.
