Judge rejects gag order for Elon Musk

Elon Musk will not have to stop talking about a lawsuit he is facing over his 2018 tweets about taking Tesla private.

US District Judge Edward Chen agreed with Musk and Tesla that the proposed temporary restraining order would be overboard as requested by the shareholder’s lawyers.

According to reporting by Reuters, Judge Chen declined the request as if passed would prevent Musk from speaking to anyone about the case.

Further to this, Judge Chen did not find any proof that Musk posed a “clear and present danger” or “serious or imminent threat” to the trial by talking publicly.

However, the Judge confirmed that he would tell jurors at the January 2023 trial that he ruled that Musk‘s tweet was false and were made with sufficient knowledge that they were false.

Nicholas Porritt, a lawyer representing the shareholders, noted he was pleased that the Judge would instruct the jurors that the tweets were false. He also pointed out that the primary remaining issue in the case is the amount of damages owed.

Neither Musk nor Tesla provided a comment on the ruling.
