A Judge hearing a class-action suit against Tesla has questioned if the Tesla legal team is taking discovery seriously.
Per a Reuters report, Federal Court Judge Tom Thawley has warned Tesla lawyers to comply with discovery orders or face strict penalties.
The lawsuit alleges that Tesla misled Australian consumers about the brand’s features, including self-driving capacity, battery range and phantom braking.
As part of discovery, Tesla was required to produce documents concerning its engineering software, computer systems and any like complaints outside of Australia. However, per the plaintiff’s lawyers, Tesla has provided only 2,000 documents, which is slowing their trial prep.
For its sake, Tesla’s lawyers have argued that there are significant concerns for the automobile manufacturer about disclosing confidential and sensitive information. They also confirmed that their legal team has reviewed 100,000 documents and needs to review another 75,000 before releasing them for discovery.
The Australian Judge has given Tesla until July 31 to wrap up its discovery process. He also wanted that “if it’s inadequate, you can expect a really bad time, and I will get into what’s gone on and whether it’s been done appropriately”.
The next case management hearing is scheduled for September 1, at which we should set the first court date.
