Twitter draws first blood in legal battle with Elon Musk

Twitter has won the first battle in what will surely be a very public trial over Elon Musk’s offer to buy the company. A Delaware judge ruled on Tuesday that the trial will be put on the fast track and start in October.

Twitter asked for a trial to start in September. In contrast, Elon Musk’s legal team asked for the trial to begin in February 2023.

Chancellor Kathaleen St. Jude McCormick noted that a longer delay could cause irreparable harm to the social media giant, supporting the argument put forth by Twitter’s legal team.

The hearing was to happen in person but switched to a virtual setting after Chancellor McCormick tested positive for COVID-19 earlier this week.

Both sides came in swinging, with Twitter’s lawyer at one point referring to Musk as a “committed enemy.”

The trial will take place in October and will last five days. However, the judge noted she would entertain a request from either side to extend the trial if necessary.

The court did not announce the exact dates for the trial.
